Terms and Conditions & Privacy Notice

Welcome to MyoloHealth (“we,” “us,” “our,” or “the App”. Please read these Terms and Conditions carefully before using our mobile application, website, and services (“Services”).

By clicking “I Accept,” accessing, or using the App, you agree to these Terms and our Privacy Notice. If you do not agree, do not use the App.

  1. Not Medical Advice
    The MyoloHealth App provides health information, educational content, and wellness tools, including a periodontal risk questionnaire. The App does not provide medical, dental, or other health advice, diagnosis, or treatment, and should be used as such, nor does this App replace the need to visit or consult with a Doctor or medical professional, as and when required.
    Using MyoloHealth does not create a doctor-patient or dentist-patient relationship between you and MyoloHealth or its developers.
    Information provided by this App may, in certain circumstances, be incomplete, inaccurate, or outdated. You should always consult your physician, dentist, or qualified health provider for diagnosis or treatment questions. Never disregard professional medical advice because of something you read on this App.
  2. Accuracy of Information
    While we aim for accurate and up-to-date information, we do not warrant that any information in the App is accurate, complete, or suitable for any purpose. Results from questionnaires or risk assessments are estimates and may be incorrect.
    Accordingly, your use of any information provided by the App should be considered appropriately and is at your own risk.
  3. Compliance and Privacy
    The Privacy Notice will govern the processing of personal data, protect the privacy of Data Subjects, allow them to exercise their rights, and ensure compliance with the relevant laws. All of our employees, contractors or consultants, independent or otherwise, will be required to act consistently with this Privacy Notice.
    We are committed to upholding the privacy of Data Subjects and all personal data processed by us, and to reiterate our commitment to safeguarding this personal data from unauthorised access, transfer or processing
    We comply with the respective Data Protection Regulations, including the Data Protection Act (2019) to protect the privacy and security of your personal data. We use administrative, technical, and physical safeguards to secure your data.
    We have a mandate to ensure that any personal data that we process is guided by various principles. They shall ensure that all data is, amongst others: -
    • Processed in accordance with the rights of the data subject
    • Processed lawfully, fairly and in a transparent manner.
    • Collected for explicit, specified and legitimate purposes and not further processed in a manner incompatible with those purposes.
  4. Data Collected

    The App may collect:

    • Personal identifiers (e.g. name, email)
    • Health information you enter (e.g. questionnaire responses)
    • Device information and usage data

    How We Use Your Data

    We may use your data to:

    • Provide requested services to you
    • Analyze and improve the App
    • Communicate with you about updates or health information ( where you have consented to the same)
    • We will not sell your personal data, and will only use your data for marketing purposes, such as sending you emails / newsletters where you have agreed to receive the same. You can always unsubscribe / opt-out should you wish to, by using the mechanisms provided or by sending us an email on _____________. You may use this email if required to contact us with any questions about the use of your personal data, as well as if you have any data access requests.

    Sharing Your Data

    We may share your data:

    • With service providers who help operate the App, under strict confidentiality agreements
    • Where required by law
    • For the performance of a contract to which you are a party
    • To fulfill requests made by you or provide services you have requested
    • If necessary to protect rights, safety.

    Your Rights

    Your rights as a Data Subject under the Data Protection Act include, but are not limited to, the right to:

    • Access or correct your data
    • Request limits on uses of your data
    • Withdraw your consent for the processing of your data

    We have several categories of data subjects whose data will be processed and controlled, due to regulatory, operational and or other needs.

    Employees

    These are individuals directly or indirectly employed by us. We may control and process data related to employees to allow for identification, validation as well as processing of regulatory information such as remittances on taxes and other key data required by the Government of Kenya. Such data may also be shared with authorised third parties where necessary for fulfilment of a contractual obligation with the respective Data Subject or based on consent.

    The data processed may also include sensitive personal / health data for e.g. biometric access control, and where applicable, for the provision of medical insurance / healthcare to the Employees. Whenever this is the case, consent of the Data Subject will always be sought along with an explanation as to the use to which the said data will be put, save for life threatening instances in which consent is not obtainable.

    Clients

    This category includes all identifiable clients who procure services and / or products from us and / or other third-party partners with whom we collaborate with to provide services and products. We may share personal data with authorised third parties in furtherance of their obligations to the Client, e.g. for delivery of ordered products or where advice is sought.

    We may control and process data related to you in furtherance of a contractual obligation where you seek advice from us, or due to legal obligations.

    Our partners

    These are all our partners who have a business relationship, collaborative initiative and existing connection either directly and or indirectly that would necessitate the processing and control of personal information on. Such processing and control might be due to regulatory compliance, internal processes and or other assessed need in line with our Notice, and accordingly, may be shared with authorised third parties.

    Storage of your personal data

    All physical personal data records shall be kept under lock and key and shall be under the sole control of our designated appointee. There shall be no copying, sharing and distribution of personal data other than that which is authorised by the Data Subject and / or necessary for the respective department to carry out their function. Digital personal data shall be stored in a secure gadget and/ or server as the need may be with access restricted to our designated appointee. We shall take all necessary measures to ensure that your personal data is stored in a secured location, which location shall be under our ownership and / or contractual ownership with the right to retention, deletion and purging of all data held by any third-party installation.

    Breach procedures

    Where personal data controlled and processed by us has been accessed or acquired by an unauthorised person, and there is a real risk of harm to the data subject whose personal data has been subjected to the unauthorised access, we shall initiate the below steps:

    • A preliminary report on the incident shall be prepared by us or our appointed representative within 48Hrs of being made aware of the breach. Such report shall detail the nature of breach, exposure / risks to Data Subject and to us, estimated costs associated with the breach including security measures to address the same, and the current status of the exposure.
    • We shall notify the Data Commissioner within seventy-two hours of becoming aware of such breach.

    Where a third-party data processor becomes aware of a personal data breach, the data processor shall notify us without delay and were reasonably practicable, within forty-eight hours of becoming aware of such breach.

    Once we receive notification of such breach we shall immediately initiate a cessation of processing of all our Data Subject data managed by the third party through notice to the said data processor, and we shall request for a detailed incident report of the facts of the breach including measures that have been put in place to mitigate further occurrence within 24 hours of receipt of notice of breach, which will inform any subsequent decision to report the matter to the Office of the Data Protection Commissioner, as required by the law and based on the circumstances of the breach.

    User Consent

    By using the MyoloHealth App and proceeding with the periodontal risk assessment:

    You consent to the collection, use, and storage of your personal data and health information as described in this Notice.

    You acknowledge that the App is not a substitute for professional medical or dental care.

    You understand that any risk scores or health insights provided are for informational purposes only and may be incomplete, inaccurate, or incorrect.

    Limitation of Liability

    MyoloHealth and its developers, partners, and affiliates are not liable for any damages, losses, or harm, howsoever caused, resulting from, inter alia:

    • Your use of the App
    • Decisions made based on App content
    • Products used based on recommendations or App content
    • Any errors or omissions in the App’s information
    • This limitation applies to the fullest extent permitted by law.
    Age Restrictions

    You must be at least 18 years old to use this App.

    Changes to Terms

    We may change these Terms at any time. Updates will be posted in the App. Continued use after changes means you accept the new Terms.

    Use of Anonymized Data for Research and Policy Advocacy

    We are committed to improving oral health outcomes and contributing to public health knowledge in Kenya.

    We may collect and use anonymized and aggregated data from users for purposes such as:

    • Analyzing trends in oral health and wellness
    • Identifying public health patterns
    • Supporting research and publications
    • Advocating for health policy improvements in Kenya

    Any data used for these purposes will not include information that identifies you personally, and accordingly, will be strictly statistical data.

    By using the MyoloHealth App, you consent to our use of anonymized and aggregated data for these purposes.
